Terms and Conditions

Definitions

“Agreement” means the agreement by which you agree to purchase and we – Edinburgh Tile Studio – agree to sell the Goods. Edinburgh Tile Studio means Wellington Interiors Ltd (trading as Edinburgh Tile Studio), incorporated in Scotland under company number SC487740, whose registered office is at Gillespie Accountancy LLP, 2-4 Salamander Place, Leith, EH6 7JB. VAT number 198 5056 65. Telephone number: 0131 629 3780. Email: enquiries@edinburghtilestudio.co.uk, and “the Client” means the customer.

“Delivery Address” means the address at which Edinburgh Tile Studio agrees to deliver the Goods, separate from Edinburgh Tile Studio. “Goods” means the goods which Edinburgh Tile Studio agree to provide you on these terms. “Delivery Date” means the date on which we agree to schedule the Goods to the Delivery Address. “Price” means price including VAT for Client retail sales, ex VAT for Business to Business sales.

Making the contract

Due to current exchange rate fluctuations, Edinburgh Tile Studio may have to re-price an existing quote, taking into account currency movements. In the main, Edinburgh Tile Studio will attempt to hold estimates / quotations valid for a period of 10 working days, provided that Edinburgh Tile Studio has not previously withdrawn it. Edinburgh Tile Studio will advise of any pricing alterations caused due to currency instability, prior to progressing any orders.

Any order issued by the Client is subject to acceptance by Edinburgh Tile Studio.

Placing an order with Edinburgh Tile Studio implies that these terms and conditions have been accepted by the client.

Products

Natural stones are by their very definition non-man-made and, as such, Mother Nature will have input in their aesthetic. That being the case, samples of the natural stones we offer will indicate the possible colour and finish of the material, but will not show all of the possible variations within the stone. You can gain a clearer idea of the stone by either visiting the showroom and discussing the matter more fully, or engaging with the product imagery on our (or our suppliers) website(s).

All descriptions, images (in print, and digitally) and samples of Goods are for the purpose of giving an approximate representation of Goods available from Edinburgh Tile Studio.

Hand-made and hand-painted tiles are subject to minor colour variation both within individual batches, and from batch to batch. Tiles may not be perfectly square due to uneven shrinkage in firing, and surfaces may vary in degree of undulation.

Over a period of time ceramic tiles may craze, which should be considered a characteristic rather than an imperfection of this type of tile.

Glass tiles can be subject to minor colour variation. Glass can also be prone to scratching – Edinburgh Tile Studio recommends careful consideration when planning glass tile placement.

All natural stones are porous to some degree, and should be sealed to protect them. Some may be easily scratched and / or be subject to pitting / chipping.

Samples

Edinburgh Tile Studio are happy to supply Samples for our Clients, with any Sample cost (excluding shipping) defrayed against a corresponding order, if the Sample is returned to Edinburgh Tile Studio.

Victorian Floor Designs

Edinburgh Tile Studio can provide design assistance for Victorian Flooring installations, with designs either free or costed depending upon our suppliers. Edinburgh Tile Studio are happy to defray any design costs against a subsequent corresponding order.

Site Visits

For certain projects, Edinburgh Tile Studio are happy to offer design assistance via a site visit arranged at a mutually agreeable time. Any travel costs, along with a flat fee of £100, ex VAT, for the first hour on site, and £50, ex VAT, for each subsequent hour, will be invoiced to the Client. Edinburgh Tile Studio are happy to refund any costs occurring from a site visit against any subsequent corresponding order.

Price & Payment

Edinburgh Tile Studio reserves the right to change the Price by giving notice at any time (prior to receipt of payment) to reflect any increase in the cost to us such as foreign exchange fluctuations, alteration of duties, supplier price alterations, and suchlike. If we change the Price and you are not happy with it, you are under no obligation to proceed with the order.

All orders must be paid for in full prior to despatch. For orders sufficiently in advance of delivery receipt, a 50% deposit will be required to secure the stock. Orders will be shipped only once all funds have cleared into Edinburgh Tile Studio’s bank account. Bespoke, non-standard, products which are fabricated specifically for you cannot be cancelled after the fabrication process has started.

Ordering

It is the Client’s duty to check that all the details relating to the order are correct, and to provide Edinburgh Tile Studio with all relevant information pertaining to the environment in which the Goods are to be used, and relating to their delivery.

Edinburgh Tile Studio provides estimates based on general guidelines and measurements provided by our Clients. It is the Client’s responsibility to provide accurate measurements so as to ensure the correct quantities of products are ordered. Edinburgh Tile Studio recommends that Clients seek professional installation advice prior to ordering as variations in surfaces and angles may affect the quantities required. Edinburgh Tile Studio accepts no responsibility for any shortfalls or surpluses. As Edinburgh Tile Studio has not carried out a survey of the installation site of the Goods, Edinburgh Tile Studio cannot give any warranty as to the suitability of the products for that, or any other given environment.

Edinburgh Tile Studio advises that our Clients order c.10% more tiles than the area to be tiled to account for cutting and wastage. This will allow for minor damages in transit, minor imperfections, as well as for tiling awkward edges where a whole tile might not be used. If too few tiles are ordered, subsequent top-up deliveries may result in batch variation. Any stock availabilities noted by Edinburgh Tile Studio are accurate at the time of quoting, though may be subject to alteration due to fluctuating stock levels at Edinburgh Tile Studio’s suppliers and distributors. Edinburgh Tile Studio accepts no responsibility for any delivery lead-time implications should stock-levels have altered between the point of quotation, and the point of ordering.

Delivery & Receipt of Goods

Stock items will usually be available for delivery in 4-5 working days (hand-painted and tiles made-to-order may have lengthier delivery lead-times). Express, or Next-day, deliveries may be available if the order is placed before 11:00 a.m. the proceeding day – additional charges may apply. Deliveries will either be made direct to site or, depending on delivery size (subject to agreement, and a £15, inc. VAT, fee), to Edinburgh Tile Studio for later personal collection.* Deliveries to the Delivery Address (depending on the volume of the order) will, in the main, be made to kerb-side only via tail-lift, and comprising of a pallet / pallets packing. The Client must make Edinburgh Tile Studio aware of any access restrictions or difficulties for a large lorry and you must ensure that a responsible person is at the Delivery Address to supervise the offload, and to sign for the Goods. A small number of our suppliers will assist with moving deliveries from kerb-side to site – please ask for guidance as to whether you can expect assistance in this fashion.

Goods delivered to site must be checked at point of receipt to ensure that they are the correct type, of satisfactory quality, undamaged, and of the correct amount. Any breakages or shortages must be recorded on the courier manifest, and details of the breakages or shortfall communicated to Edinburgh Tile Studio within 48 hours (in the instance of breakages, an accompanying photograph is required). In the event of either breakages or shortages, Edinburgh Tile Studio will organise for the necessary tiles (replacements, or additions) to be delivered with delivery to site as quickly as possible (Edinburgh Tile Studio will not be held liable for any lost installation time due to shortages resulting from breakages, incorrect picks from our suppliers, or delayed deliveries). Replacements / additions supplied will be as close as possible to the initial order batch, current stock levels allowing. Edinburgh Tile Studio’s total liability will not in any event exceed the price. Any delivery packaging / pallets are the responsibility of the Client to dispose of. If the goods are not rejected, or Edinburgh Tile Studio is not notified of issues within the timeframe specified, or the goods are installed, Edinburgh Tile Studio will consider that you have accepted the Goods, and will have no liability to you.

Edinburgh Tile Studio reserves the right to make delivery by instalments, and to tender a separate invoice in respect of each instalment. When delivery is to be by instalment, or Edinburgh Tile Studio exercises its right to deliver by instalment, or if there be a delay in the delivery of any one or more instalments for whatever reason, this will not entitle the Client to treat the purchase / Agreement as repudiated, and / or damages.

Edinburgh Tile Studio will endeavour to have the Goods delivered to the Delivery Address on the Delivery Date, but time for this delivery is not of the essence of this Agreement. Edinburgh Tile Studio and our suppliers often use independent delivery companies for which we are not responsible so we cannot guarantee delivery times. Please consult Edinburgh Tile Studio should you have any concerns about delivery schedule.

Delivery costs will be applied to any quotations supplied, will be subject to VAT, and will be in addition to the Price of the Goods.

If Edinburgh Tile Studio or our couriers are not able to deliver the Goods as a result of you not complying with your obligations under these terms, the Goods will be retained by the courier, and you will be responsible for any re-delivery or storage charges incurred.

Care needs to be taken when unpacking the Goods. The Goods should always be stacked and stored vertically (on edge) but not on a hard surface, as this may cause unnecessary edge chipping. Edinburgh Tile Studio cannot be held liable for damage to the Goods which occurs after delivery or after collection (in instances where tiles are collected from Edinburgh Tile Studio).

Installations

Any advice given by Edinburgh Tile Studio relating to fixing products and installation is given in good faith, but should be used as a general guide only as Edinburgh Tile Studio have not carried out a survey of the place of installation of the goods, and cannot therefore be sure that our advice is correct. It is your responsibility to purchase the correct fixing products and sealants for the environment in which (and in particular the surface upon which) the Goods are to be installed.

It is the Client’s responsibility to ensure that a professional fitter is installing your tiles. Edinburgh Tile Studio always recommends that our Clients take advice from a professional tile fitter, and you take up independent references. While Edinburgh Tile Studio does not provide a managed installation service, we are happy to put clients in touch with an experienced tile fitter. Although Edinburgh Tile Studio is happy to advise on installation techniques – please consult, as appropriate – Edinburgh Tile Studio does not guarantee third party installations, and cannot be held responsible for the manner of installation of the Goods, or for damage caused during or arising out of the installation. In particular, we will not be held liable for a failure to install the Goods correctly, failure to make the necessary preparatory work (involving correct bases, sealants, or installation techniques), or if the installation environment in which the goods are placed is unsuitable.

Please be aware that natural stone tiles may need to dry out before the installation process begins. Advice should be sought from an experienced fitter as to whether this is the case for your Goods.

All natural stone – and some porcelains – need to be sealed to protect from stains or watermarks. Edinburgh Tile Studio can offer a variety of sealers, depending on preference – our stock sealers and treatments are by LTP, a range which secures the surface of the product without changing the appearance of the stone.

Refunds

Should you change your mind prior to your order being despatched, Edinburgh Tile Studio will offer a full refund. For goods already despatched or receipted:

  • Certain of Edinburgh Tile Studio’s suppliers will only accept returns in exceptional circumstances. Please consult staff prior to confirming your order if this is a concern.
  • Edinburgh Tile Studio may only be able to accept returns of full-box quantities, so please measure and order with care. Again, please consult staff as necessary.
  • Returns authorisation must be sought in writing within 14 days of receipt of the Goods. Verbal communication of the refund must be confirmed within writing, within the timeframe.
  • Edinburgh Tile Studio will deduct any applicable return delivery costs, and apply any restocking fees which our suppliers require, from any refund. We will also apply a £20, ex VAT, bureaucratic fee to cover business costs resulting from the refund.
  • If the Client arranges return of the Goods directly, any delivery / packing costs, and delivery insurances, will be their responsibility until the goods are receipted at destination.
  • Goods must be returned unbroken, in original packaging where possible. Edinburgh Tile Studio reserves the right to charge for any damages caused by client failure to carry out necessary duty of care.
  • Installed tiles, hand-painted tiles, and made-to-order tiles are non-returnable. Hand-painted tiles and tiles which are made-to-order cannot be cancelled or refunded once the order has been placed with Edinburgh Tile Studio’s
  • Original delivery costs will not be refunded.

Please do bear in mind that tiles can vary from batch to batch – it is advisable to keep extra in case replacements are required at a future date. Refunds will be processed within 5 working days of Edinburgh Tile Studio receiving the relevant credit from our suppliers.

Other Terms

Edinburgh Tile Studio cannot be held responsible for circumstances out-with our reasonable control. This may include (without limitation) shortfalls at our suppliers, natural disasters, and restraints or delays affecting our suppliers, or transportation to site or to Edinburgh Tile Studio. We will endeavour to notify you as soon as possible should there be any problems of this sort.

Nothing in these terms is intended to limit any rights which the Client may have as a consumer under statute, or to limit Edinburgh Tile Studio’s liability to you in respect of death or personal injury resulting from Edinburgh Tile Studio’s negligence, or for fraud or fraudulent misrepresentation in respect of an untrue or misleading statement.

These terms are not intended to, and does not, give any third parties any right to enforce any of its provisions.

There cannot be a variation or change to anything in these terms without expressed agreement, confirmed in writing, and signed by both parties.

 

*Warmup underfloor heating deliveries are only to Edinburgh Tile Studio, and will not incur an additional fee.
